If you are unfortunate enough to suffer an assault, please ensure you remember the following 3 steps:

Step 1: Notify the police immediately about the assault. The next day is too late! You have to report the matter yourself.

 Step 2: Obtain a Crime Reference Number from the police. This identifies your incident and is a vital piece of information.

Step 3: Note the details of witnesses. Information may be required from them at a later date.

General

It is now possible to make small changes to your premises licence or club premises certificate through the Minor Variation process, which is cheaper, easier and quicker than the full variation process.

The test for whether a proposed variation is ‘minor’ is whether it could impact adversely on any of the four licensing objectives. (These are: the prevention of crime and disorder; public safety; the prevention of public nuisance; and the protection of children from harm.)

We expect that the process will be used for changes such as:

  • small changes to the structure or layout of a premises;
  • the addition of authorisation for late night refreshment or regulated entertainment (such as live music, performance of plays or film exhibitions);
  • small changes to licensing hours (but see below on changes that relate to alcohol);
  • revisions, removals and additions of conditions (this could include the removal or amendment of out of date, irrelevant or unenforceable conditions, or the addition of volunteered conditions).

The Minor Variations process cannot be used to:

  • add the retail or supply of alcohol to a licence
  • extend licensing hours for the sale or supply of alcohol at any time between 11pm and 7am;
  • increase the amount of time on any day during which alcohol may be sold by retail or supplied;
  • extend the period for which the licence or certificate has effect;
  • transfer the licence or certificate from one premises to another, or vary substantially the premises to which it relates
  • specify, in a premises licence, an individual as the premises supervisor;
  • add the sale by retail or supply of alcohol as an activity authorised by a licence or certificate; or
  • disapply the mandatory conditions relating to a designated premises supervisor (there is a separate process by which community premises can apply for this).

Customer Feeback

"The half day course for Designated Premises Supervisors was pitched at just the right level to give them a reminder of their roles and responsibilities under the Licensing Act 2003. Delegates were able to interact with each other and share best practice. The content of the session also gave them a useful insight into practical due diligence procedures they could employ at their premises. The session for staff at retails outlets gave them an overview of the legislation. It is surprising that many employees do not fully understand the legal implications of the licence operating at their premises and what could happen if breaches occur. Likewise the course brought home the implications of irresponsible selling of alcohol and the importance that serving staff have in controlling sales. The afternoon session on conflict management skills showed how to deal with difficult, intimidating and potentially dangerous customers. The majority of delegates went away saying that they would now change their approach to such situations having been made aware of how their own behaviour can sometimes fail to calm things down as well as sometimes inflame a situation. The trainers style worked for all of the delegates and the courses are something we would certainly consider running again, given sufficient funding. "
